13.Cookies and other technologies

We collect data automatically through the use of “cookies”. Cookies can be set by us or by third parties. A cookie is a text file that contains a small amount of data that a website can send to your browser and is then stored on your computer as an anonymous tag to identify your computer, but not you. Some of the pages on our website use cookies to provide you with better service when you return to the website. You can set which cookies we are allowed to activate in our cookie settings.

We also use web beacons, which are also generally known as “one-pixel GIFs”, “clear GIFs” or “tags”. Web beacons are small graphic files that can be included on our website. Web beacons allow us to optimize our products and services and to provide us and third party partners with analysis data, for example how many visitors our website has. We can also use web beacons in our e-mail correspondence to determine whether you are opening an e-mail or taking further action. We also work with other organizations to place our web beacons on their websites or in their advertisements. We do this so that we can compile statistics on.

For our apps, we automatically collect data through the use of device IDs (“IDs”). An ID is a specific sequence of numbers and letters (“character string”) that is assigned to your device, but not you identified. The ID allows us and third parties selected by us to record your behavior when you use the app. Almost every app uses ID technology. IDs serve various purposes; for example, they remember your preferences and generally provide a better user experience. IDs can tell us, for example, whether you have used our app before or whether you are doing this for the first time. It can also ensure that the advertisements you see through the app are tailored to you and your interests.

We use pixel tags (also called tracking pixels) as part of our online offering. Pixels are small graphics that are integrated into the HTML code of our site. The pixel tag itself does not store or change any information on your end device, so pixels do not cause any damage to your end device and do not contain viruses, Trojans or other malware.

Pixels can send personal data, such as your IP address, the referrer URL of the website visited, the time at which the pixel was viewed, the browser used, as well as previously set cookie information to a web server. This makes it possible to carry out reach measurements and other statistical evaluations, which serve to optimize our offer.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

In addition, we also use temporary cookies to optimize user-friendliness, which are stored on your terminal device for a certain fixed period of time. If you visit our site again to use our services, it is automatically recognized that you have already been to our site and which entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies and pixel tags as part of third-party tools to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. These cookies and pixel tags enable us to automatically recognize that you have already been to our website when you visit it again. These cookies are automatically deleted after a defined period of time.

The data processed by cookies and pixel tags are necessary for the aforementioned purposes to protect our legitimate interests in the analysis, optimization and economic operation of our offer according to Art. 6 para. 1 p. 1 lit. f DSGVO.

Most browsers accept cookies and pixels automatically. However, you can configure your browser so that no cookies are stored on your computer or a notice always appears before a new cookie is created. However, the complete deactivation of cookies may mean that you cannot use all the functions of our website.

In addition, you can also prevent the use of pixels on our pages by using appropriate tools or browser add-ons (e.g. by using the “AdBlock” add-on). You can find further opt-out options in the following information about the tracking measures we use.

The use of Google WebFonts is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the uniform presentation of the typeface on his website. If a corresponding consent has been requested (e.g. a consent to store cookies), the processing is carried out exclusively on the basis of Art. 6 (1) lit. a DSGVO; the consent can be revoked at any time.

If you did not give consent a standard font from your computer will be used. Same applies, if your browser does not support web fonts.

complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

Information about your right to object according to Art. 21 DSGVO.

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(f) of the DSGVO (data processing on the basis of a balance of interests); this also applies to Article 4(4) DSGVO profiling based on this provision.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims.

If your objection is directed against processing of data for the purpose of direct marketing, we will immediately stop the processing. In this case, it is not necessary to specify a particular situation. This also applies to profiling, insofar as it is related to such direct advertising.

If you wish to exercise your right to object, an e-mail to legal@vivantbiotechnology.com will suffice.

18.Profiling

We may use your data to try to find out more about you so that we may be better able to predict which products and services you may be interested in.

On some of our e-commerce websites, we commission service providers who use automated decision-making processes to check your address and creditworthiness. This enables us to ensure that we are using correct address information and to assess the risk of non-payment for our products and services.

19.Data Security

We use physical, technical and administrative measures to protect your personal data stored by us against unauthorized access, collection, use, publication, reproduction, modification or deletion. All data that you provide to us is stored on secure servers.

If you have a password to access our website or app, you are responsible for keeping the password safe and keeping it confidential.

All data transmitted by you personally will be encrypted using the generally accepted and secure standard TLS (Transport Layer Security). TLS is a secure and proven standard that is also used, for example, in online banking. You can recognize a secure TLS connection, among other things, by the appended s at the http (i.e. https://..) in the address bar of your browser or by the lock symbol in the lower area of your browser.

We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

20.Third Countries

Due to the fact that the Internet offers a global environment, the collection and processing of personal data via the Internet inevitably includes the international transfer of data. Although we usually store personal data that we collect about you through our website in your region (for example in the European Economic Area in the case of visitors from Europe), your personal data may also be passed on to parties outside your region (where other data protection laws apply, e.g. in the USA), among others to affiliated companies of Vivant Biotechnology GmbH .

If this is done, we have implemented protective measures and data protection solutions to ensure that your data is adequately protected in third countries, e.g. by using standard contractual clauses or, if necessary, invoking the Privacy Shield. If you would like more information on this, please contact us at the email address given in sections below.
